Types of Disciplinary Sanctions and Their Distinction from Criminal Sanctions in Libyan and Comparative Law
Abstract
Disciplinary sanctions play a vital role in the disciplinary system; indeed, the very nature of such sanctions prompted the legislator to introduce them in order to safeguard the public order of administrative services. This is because criminal penalties are ill-suited for the administrative sphere—given that the objective of criminal punishment is to protect society from harm—and because applying them within the civil service would disrupt the functioning of the public service.
